Agreement to Terms
By accessing or using the NutmegBuilds website (nutmegbuilds.com) and services, you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our website or services.
Services
NutmegBuilds provides web development and custom software development services. Specific services, deliverables, timelines, and pricing will be outlined in individual service agreements or proposals provided to each client.
Subscription Plans and Commitment
All NutmegBuilds service plans are monthly subscriptions with no setup fees.
- -All plans require a 6-month minimum commitment from the subscription start date
- -Monthly subscription fees are billed on the first of each month via Stripe
- -Late payments may result in service suspension after 15 days
- -All fees are in US dollars
Content Change Limits
Each plan includes a specific number of content changes per month:

Cancellation and Early Termination
During the 6-month minimum period
Early cancellation incurs a fee equal to the remaining months at 50% of your plan rate. For example, if you cancel a $299/mo plan with 3 months remaining, the early cancellation fee would be $448.50.
After the minimum period
Either party may terminate ongoing services with 30 days written notice. Monthly fees are not refunded for partial months.
Upon cancellation, we will provide all your content and assist with a smooth transition.
Intellectual Property
Client owns
All website content, including text, images, branding materials, and any content provided by or created for the client.
Monthly subscription plans
NutmegBuilds retains ownership of the website code, design, and technical implementation for the duration of the subscription. Clients on active plans may not copy, transfer, or redistribute the code.
Custom development projects
Upon final payment, the client receives full ownership of all custom code, design, and deliverables created for their project. NutmegBuilds retains no rights to the delivered code beyond the portfolio showcase right described below.
Portfolio
NutmegBuilds retains the right to showcase completed work in our portfolio unless otherwise agreed in writing.
Third-party tools, frameworks, and open-source components used in projects remain subject to their respective licenses.
Service Level
NutmegBuilds targets 99.9% uptime for all hosted websites. Scheduled maintenance windows will be communicated in advance. This is a target, not a guarantee, and NutmegBuilds is not liable for downtime caused by third-party providers, force majeure events, or client actions.
Limitation of Liability
NutmegBuilds shall not be liable for any indirect, incidental, special, or consequential damages arising from the use of our services. Our total liability shall not exceed the amount paid by the client in the 12 months preceding the claim.
Website Use
You agree not to:
- -Use our website for any unlawful purpose
- -Attempt to gain unauthorized access to our systems
- -Interfere with the proper functioning of our website
- -Copy or reproduce our content without permission
Governing Law
These terms are governed by the laws of the State of Connecticut. Any disputes shall be resolved in the courts of Fairfield County, Connecticut.

Changes
