Agreement to Terms
By accessing or using the NutmegBuilds website (nutmegbuilds.com) and services, you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our website or services.
Services
NutmegBuilds provides web development and custom software development services. Pricing for the website build and the Covered, Reach and Operate plans is published on this site. Custom development projects, whether a fixed-scope build or an embedded retainer, are scoped and quoted individually before any work begins.
The Website and the Monthly Service
NutmegBuilds sells the website once and offers ongoing development on a subscription, with no minimum term. There are three monthly tiers, Covered, Reach and Operate.
- -The website build is $1,995 total: 60% ($1,197) to start, 40% ($798) once it's built, due before the site is published live
- -You own the code, the content and the design from the day the site goes live
- -Covered is $149/month, month to month, with no minimum term and no early termination fee
- -Reach is $399/month, month to month, with no minimum term and no early termination fee
- -Operate is $799/month, month to month, with no minimum term and no early termination fee
- -Monthly fees are billed on the first of each month via Stripe
- -Late payments may result in service suspension after 15 days
- -All fees are in US dollars and exclusive of Connecticut sales tax where applicable
Covered, Reach and Operate
Covered and Reach include one site change a week: you send it, we work it and it ships inside that week. Send several and the rest wait in the queue in the order they arrived; you get a notification the moment each one is done. Two things sit outside that count. Something broken never uses your week and is picked up straight away. And a project — a new feature or an integration — is a different size of job: it starts when the project lane is free and gets a timeline once we have scoped it, not a one-week promise we would be making before knowing what is inside. None promise a business outcome — no lead count, no review count, no ranking. All are development and maintenance services.
When several requests land in the same week, they are worked in tier order: Operate first, because those sites run on a system the business depends on, then Reach, then Covered, and oldest first within each. This decides what gets picked up first inside the week; it does not change which week your request belongs to, and every request still ships inside its own week.
A monthly technical health report (uptime, speed, broken links, SSL) with 1-2 improvement suggestions you can accept or skip, automated backups and security updates, plus text edits, photo swaps, hours, pricing, service areas, new team members, seasonal updates, bug fixes and technical maintenance. One request a week, delivered inside that week, with no page limits and no cap on revisions to it.
Everything included in Covered, plus new features, integrations and improvements that go beyond a simple update — booking forms, galleries, connecting tools you already use. A project runs alongside the weekly request and is built one at a time, because a project takes longer than a week and is a different kind of work than a content change. Reach work is picked up ahead of Covered when both land in the same week.
For a site built around a custom operational system the business depends on to run, such as bookings with confirmation and cancellation, job tracking, or a payment integration. Operate is measured in hours rather than in a weekly count, so send as much as fits in the eight. Includes active monitoring of that system, and issues affecting it jump the queue ahead of Covered and Reach requests. Whether a site qualifies for Operate is agreed when the system is scoped, not assigned unilaterally afterward.
Building a system that needs its own data model, its own state, or an admin panel is a custom development project, starting at $4,000. Once that system is live, ongoing care for it is Operate, not Covered or Reach.
Cancellation and Early Termination
There is no minimum term and no termination fee
Either party may end the monthly service with 30 days written notice, at any time. Monthly fees are not refunded for partial months.
You keep everything
If you cancel the monthly service, the website stays live and stays yours. We transfer the code repository and the Google Business Profile to you, and we remove our access. There is nothing to buy back.
60-day workmanship guarantee on the build
For 60 days after launch, if the delivered website does not materially match the approved scope, is not mobile-responsive, has a functional defect caused by our work, or is missing an agreed page, form, or tracking item, we fix it at no charge. If we are unable or unwilling to correct a material workmanship issue after written notice and a reasonable chance to fix it, we refund the $1,995 build fee.
This guarantee covers the website we delivered. It does not cover business outcomes, rankings, lead volume, review ratings, or results affected by your pricing, responsiveness, or customer service.
Upon cancellation, we will provide all your content and assist with a smooth transition.
Intellectual Property
The client owns the website
On payment of the build fee, the client receives full ownership of the website code, design and content. NutmegBuilds retains no rights over the delivered site beyond the portfolio showcase right described below, and holds nothing back as leverage against cancellation.
What transfers on cancellation
If the monthly service ends, NutmegBuilds transfers the code repository and ownership of the Google Business Profile to the client, and removes its own access. There is no buy-back fee and no release fee.
Custom development projects
For fixed-scope projects, the client receives full ownership of all custom code, design, and deliverables upon final payment. For an embedded retainer, ownership of work delivered each month transfers as it is paid for. NutmegBuilds retains no rights to delivered code beyond the portfolio showcase right described below.
Portfolio
NutmegBuilds retains the right to showcase completed work in our portfolio unless otherwise agreed in writing.
Third-party tools, frameworks, and open-source components used in projects remain subject to their respective licenses.
Service Level
NutmegBuilds targets 99.9% uptime for all hosted websites. Scheduled maintenance windows will be communicated in advance. This is a target, not a guarantee, and NutmegBuilds is not liable for downtime caused by third-party providers, force majeure events, or client actions.
Limitation of Liability
NutmegBuilds shall not be liable for any indirect, incidental, special, or consequential damages arising from the use of our services. Our total liability shall not exceed the total amount the client has paid to NutmegBuilds.
Website Use
You agree not to:
- -Use our website for any unlawful purpose
- -Attempt to gain unauthorized access to our systems
- -Interfere with the proper functioning of our website
- -Copy or reproduce our content without permission
Governing Law
These terms are governed by the laws of the State of Connecticut. Any disputes shall be resolved in the courts of Fairfield County, Connecticut.

Changes
